This article is an attempt to understand “Bounds of Ethics in a Globalized World”, the hiatus between principles, norms and values and how they are codified on the one hand and the risks that follow when the actualisations of regulative principles fail in political reality on the other hand. Considering the political, economic and social reality, it is frequently diagnosed that reality is lagging far behind the potential of constitutionally guaranteed rights and duties. A variety of constitutionally guaranteed values suffers (...) from devaluation. Taking examples from Bavaria in Germany, questions concerning whether the Bavarian society is at the borders of ethical capacities, or whether the limits of possible ethical regulation have been reached are dealt with. Important parallels in the genesis of the Bavarian and the Indian constitution are highlighted in this context. Through an understanding of the ideas of Ludwig Erhard, a pragmatic approach and an innovative model is proposed for cultivating values in a sustainable way. The importance of values of virtues is discussed and an emphasis is put on the importance of practiced virtues. (shrink)

This study aims to describe social network and social participation and to assess associations with depressive symptoms in older persons with increased risk for dementia in Germany. We conducted a cross-sectional observational study in primary care patients (aged 60-77) as part of a multicenter cluster-randomized controlled trial (AgeWell.de). We present descriptive and multivariate analyses for social networks (Lubben Social Network Scale and subscales) and social participation (item list of social activities) and analyze associations of these variables with depressive symptoms (Geriatric (...) Depression Scale). Of 1030 included patients, 17.2% were at risk for social isolation (Lubben Social Network Scale < 12). Looking at the subscales, a reduced non-family network was found almost twice as often as a reduced family network. Patients with depressive symptoms had significantly smaller social networks than patients without depression (p < 0.001). They rather engaged in social activities of low involvement level or no weekly social activity at all (p < 0.001). The study shows associations of depressive symptoms with a decreased social network and less social participation in elderly participants. Sufficient non-family contacts and weekly social activities seem to play an important role in mental health and should be encouraged in elderly primary care patients. (shrink)

In dieser Untersuchung zum Demarkationsproblem wird auf der Grundlage eines rational rekonstruierten Konzepts von Wissenschaft ein Ansatz zur Bewertung des wissenschaftlichen Status von mutmaßlich pseudowissenschaftlichen Glaubenssystemen entwickelt. Der instrumentelle Wert des Konzepts wird durch eine Kritik des Intelligent Designs belegt.

Contributions to the philosophical genre of popular culture and philosophy aim to popularize philosophical ideas with the help of references to the products of popular culture with TV series like The Simpsons, Hollywood blockbusters like The Matrix and Jurassic Park, or popular music groups like Metallica. While being commercially successful, books in this comparatively new genre are often criticized for lacking scientific rigor, providing a shallow cultural commentary, and having little didactic value to foster philosophical understanding. This paper discusses some (...) of these methodological and didactic objections and seeks to encourage a constructive discussion of concerns with the genre. It shows how the genre similar to previous attempts to foster public understanding of philosophy and that it is a methodologically viable approach to reach a broad range of readers with diverse informational preferences and educational backgrounds. Considering what makes this approach to the popularization of philosophical thinking successful will shed light on some of the criteria for popularization of philosophy in general. (shrink)

Financial conflicts of interest in medical research foster deviations from research standards and evidentially lead to the suppression of research findings that are at odds with commercial interests of pharmaceutical companies. Questionable research practices prevent data from being created, made available, or given suitable recognition. They run counter to codified principles of responsible conduct of research, such as honesty, openness or respect for the law. Resulting in ignorance, misrepresentation and suspension of scientific self-correction, suppression of medical evidence in its various (...) forms is both a threat to the epistemic and the moral integrity of medical science. This paper discusses an example of the suppression of medical evidence in recent influenza research and develops a conceptual framework for the description and assessment of questionable research practices applied in research and publication processes to suppress evidence. Ellen Ripley stands out from the ordinary, stereotypical women in horror and science fiction movies up until the release of Alien in 1979. It isn't hard to interpret Ripley's fight against the Xenomorphs as a metaphor for the feminist struggle against sexual violence directed at women, or to see her actions as violent opposition to those who would deny her sexual self‐determination. Proponents of care‐focused approaches observe that women have a special way of moral reasoning, whereas status‐oriented thinkers seek to (...) overcome gender‐based inequalities and unjust social relationships through criticizing status differences between men and women, like stereotypes and differences in pay for the same work. Two brief examples from Aliens illustrate the difference between these approaches. This chapter considers whether Ripley exercises a feminist ethics of care. In the last scene of Alien, Ripley's strong identification with her professional role shows itself again when she makes a final entry in the Nostromo's log. (shrink)

Forschungsskandale und Diskussionen über Strukturprobleme der Biomedizin evozieren oft die Forderung nach mehr Verantwortung in der Forschung und der Einhaltung von Prinzipien guter wissenschaftlicher Praxis. Doch was genau ist „gute wissenschaftliche Praxis“ und wie kann die Forschungsgemeinschaft Verantwortung für die Verlässlichkeit von Forschungs- und Publikationsprozessen übernehmen? Die vorliegende Untersuchung beantwortet diese Fragen in Form einer prinzipienbasierten Forschungsethik. Durch Fallstudien über Datenfälschung in der Stammzellenforschung, Datenunterdrückung in der Influenzaforschung und die Kontamination von Zellkulturen in der Krebsforschung wird insbesondere gezeigt, dass wissenschaftliche (...) Selbstkorrektur kein notwendig eintretender Effekt der kollektiven Suche nach Erkenntnis ist. Vielmehr sind die Prävention, Identifikation und Korrektur von Fehlern in Forschungs- und Publikationsprozessen Resultate der intendierten Bemühung um epistemische Integrität im konkreten professionellen Handeln. Prinzipien der guten wissenschaftlichen Praxis - wie Ehrlichkeit, Unvoreingenommenheit, Anerkennung wissenschaftlicher Leistung und Kollegialität - müssen deswegen als handlungsleitende Regeln konkretisiert werden. Disney's Zootopia (2016) is a crime story about the involuntary partnership between Judy Hopps, the first rabbit police officer in the city of Zootopia, and Nick Wilde, a red fox making his living as a con artist. What makes Zootopia a utopia and the city of Judy's dreams is that it appears to be “where anyone can be anything.” Zootopia confronts people with three utopian ideals: of security and social order, of individual self‐determination and fulfillment, and of a just multispecies (...) society. Zootopia begins with the founding myth that tells the story of how the animals overcame an anything‐but‐ideal natural state, in which prey animals lived in constant fear of predators. Zootopia is too much of a metaphor for human ways of life to be a utopian human‐animal society, and too “messy” to count as a metaphoric utopia for humans. (shrink)

“Archangel” explores the consequences of Marie's over‐parenting of her daughter, Sara, through the use of a neural implant (the Archangel) that allows Marie to track (and block) Sara's experiences. In attempting to fulfill her duty to protect Sara, Marie ultimately fails morally as a parent. What is fascinating is that different schools of philosophical thought – contemporary liberal philosophy, ancient Greek Aristotelian ethics, contemporary feminist ethics of care, and contemporary Wittgensteinian ethics – all reach the same conclusion about Marie's moral (...) failure, while teasing out different strands of this failure. In attempts to compare different distributions with regards to need, so-called “measures of need-based distributive justice” have emerged in recent years. Each of the proposed measures relies on a single dimension of need that is taken into account. This is shown to be problematic since humans experience different kinds of need that appear to be incommensurable. A strategy to deal with this problem is introduced by using multidimensional measures.

The formal part of this chapter is concerned with measures of need-based justice. According to the measures we propose, a distribution is unjust (i) the more it deviates from absolute need satisfaction and equal degrees of need satisfaction, (ii) the more the given undersupply could have been mitigated by transfers, or (iii) the more resources are used for oversupply instead of need satisfaction. These measures are compared, i.e., as to the satisfaction of need-oriented relatives of axioms prominent in poverty measurement; (...) and we have a critical eye on the proposals of Jasso and Miller. The empirical part reports on three vignette studies conducted to find out how people evaluate the justice of given distributions and how they distribute goods when aiming at justice. The main goal was to measure the significance ascribed to need. This significance was compared with the significance ascribed to effort or equality; and it was shown that a need’s influence decreases when the corresponding person is accountable for having a higher amount of it. In the third study, we found out that needs that are not directed at bare survival, such as the need for participation in social life, are attributed lower degrees of importance. The chapter concludes with some implications of our research for a theory of need-based justice. (shrink)

While organizations today make extensive use of complex algorithms, the notion of algorithmic accountability remains an elusive ideal due to the opacity and fluidity of algorithms. In this article, we develop a framework for managing algorithmic accountability that highlights three interrelated dimensions: reputational concerns, engagement strategies, and discourse principles. The framework clarifies that accountability processes for algorithms are driven by reputational concerns about the epistemic setup, opacity, and outcomes of algorithms; that the way in which organizations practically engage with emergent (...) expectations about algorithms may be manipulative, adaptive, or moral; and that when accountability relationships are heavily burdened by the opacity and fluidity of complex algorithmic systems, the emphasis of engagement should shift to a rational communication process through which a continuous and tentative assessment of the development, workings, and consequences of algorithms can be achieved over time. The degree to which such engagement is, in fact, rational can be assessed based on four discourse-ethical principles of participation, comprehension, multivocality, and responsiveness. We conclude that the framework may help organizations and their environments to jointly work toward greater accountability for complex algorithms. It may further help organizations in reputational positioning surrounding accountability issues. The discourse-ethical principles introduced in this article are meant to elevate these positioning contests to extend beyond mere adaption or compliance and help guide organizations to find moral and forward-looking solutions to accountability issues. Needs play a key role in many fields of social sciences and humanities, ranging from normative theories of distributive justice to conceptions of the welfare state. Over time, different conceptions of what counts as a need (i. e., what is considered a normatively relevant need) have been proposed. Many of them include (in one way or the other) needs for survival, decency, belonging, and autonomy. Little work has been done on how these kinds of needs are evaluated in terms of (...) their significance for distributive justice. To begin closing this gap, we investigate the role of the four aforementioned kinds of needs for impartial observers. We do so in two empirical studies. The first study asks participants to evaluate the importance of each of the four kinds of needs separately. We find that different levels of importance are attributed to the kinds of needs, which places them in a hierarchy. The second study asks participants to make distributive decisions. Results further support the hierarchy found in the first study and, additionally, reveal that participants tend to make coherent allocation decisions. (shrink)

Livengood and Sytsma (2020) challenge the Compositionality Constraint of Actual Causation (CCAC), according to which each intermediary of a causal chain is an effect of its predecessor and a cause of its successor link. In several studies, they find support for their hypothesis that the CCAC is not in accordance with ordinary causal attributions of laypeople. We argue that there are three interrelated problems in their studies’ design that we call the Causality-Responsibility Confusion (CRC), the Intermediary-Ontology Confusion (IOC), and the (...) Cause-End Questioning (CEQ). Avoiding the CRC, the IOC, and the CEQ leads to strong empirical support for the CCAC. (shrink)

Two questions often shape our view of the world. On the one hand, we ask what there is, on the other hand, we ask what there ought to be. Empirical research and normative theory, the methodological traditions concerned with these questions, entered a difficult relationship, from at least as early as around the time of the advent of modern sciences. To this day, there remains a strong separation between the two domains, with both tending to neglect discourses and results from (...) the other. Contrary to a verdict of strict segregation between »is« and »ought«, there are, nowadays, various attempts to integrate both theoretical approaches. This calls for a newly intensified discourse on the relation between empirical research and normative theory. In this volume, scholars from different disciplines – including psychology, sociology, economics, and philosophy – discuss possible desired or undesired influences on, and limits of, the integration of these two approaches. We report the results of a vignette study with an online sample of the German adult population in which we analyze the interplay between need, equity, and accountability in third-party distribution decisions. We asked participants to divide firewood between two hypothetical persons who either differ in their need for heat or in their productivity in terms of their ability to chop wood. The study systematically varies the persons’ accountability for their neediness as well as for their productivity. We find that (...) participants distribute significantly fewer logs of wood to persons who are held accountable for their disadvantage. Independently of being held accountable or not, the needier person is partially compensated with a share of logs that exceeds her contribution, while the person who contributes less is given a share of logs smaller than her need share. Moreover, there is a domain effect in terms of participants being more sensitive to lower contributions than to greater need. (shrink)

Jonathan Livengood and Justin Sytsma have published a series of studies on “Actual Causation and Compositionality,” in which they investigate causal attributions of laypeople. We use one of their vignettes to follow up on their research. Our findings cast doubt on their conclusion that ordinary causal attributions tend to violate the compositionality constraint if one looks at cases in which someone is responsible for an effect by way of an intermediary that does not share in the responsibility.

Verteilungsgerechtigkeit befasst sich mit der Verteilung von Gütern innerhalb einer Gruppe, wobei verschiedene Verteilungsprinzipien und -ergebnisse als mögliche Ideale einer solchen Verteilung verhandelt werden. Diese normativen Ansätze sind oft rein verbal formuliert, wodurch ihre Anwendung auf unterschiedliche konkrete Verteilungssituationen, die hinsichtlich ihrer Gerechtigkeit beurteilt werden sollen, häufig schwer fällt. Eine Möglichkeit, fein abgestufte Gerechtigkeitsbeurteilungen verschiedener Verteilungen präzise erfassen zu können, besteht in der formalen Modellierung solcher Ideale durch Maße oder Indizes. Die Auswahl eines geeigneten Maßes, das ein gewisses Ideal abbilden (...) soll, muss ihrerseits eine Fundierung erfahren, was durch die Forderung von begründeten Axiomen erreicht werden kann, denen ein Maß genügen soll. In der vorliegenden Arbeit werden solche Axiome für Maße der Verteilungsgerechtigkeit am Beispiel von Bedarfsgerechtigkeit eingeführt. Ferner werden exemplarische Maße der Bedarfsgerechtigkeit vorgestellt. Damit wird für die Beurteilung und Modellierung von Maßen der Verteilungsgerechtigkeit eine erste diskutable Grundlage gelegt. Distributive justice deals with allocations of goods and bads within a group. Different principles and results of distributions are seen as possible ideals. Often those normative approaches are solely framed verbally, which complicates the application to different concrete distribution situations that are supposed to be evaluated in regard to justice. One possibility in order to frame this precisely and to allow for a fine-grained evaluation of justice lies in formal modelling of these ideals by metrics. Choosing a metric that is (...) supposed to map a certain ideal has to be justified. Such justification might be given by demanding specific substantiated axioms, which have to be met by a metric. This paper introduces such axioms for metrics of distributive justice shown by the example of needs-based justice. Furthermore, some exemplary metrics of needs-based justice and a three dimensional method for visualisation of non-comparative justice axioms or evaluations are presented. Therewith, a base worth discussing for the evaluation and modelling of metrics of distributive justice is given. (shrink)

We examine the role of need satisfaction in non-comparative justice ratings about endowments with goods. As normative approaches, we discuss utilitarianism, prioritarianism, and sufficientarianism. Using a vignette experiment, we show that a need context increases the prevalence of prioritarianistic and sufficientarianistic justice ratings, which leads to an ethically problematic sigmoid shape of the justice evaluation function.

Need considerations play an important role in empirically informed theories of distributive justice. We propose a concept of need-based justice that is related to social participation and provide an ethical measurement of need-based justice. The β-ε-index satisfies the need-principle, monotonicity, sensitivity, transfer and several »technical« axioms. A numerical example is given.

ObjectiveIn this study we used functional magnetic resonance imaging to investigate whether motor imagery of handwriting and circle drawing activates a similar handwriting network as writing and drawing itself.MethodsEighteen healthy right-handed participants wrote the German word “Wellen” and drew continuously circles in a sitting and lying position to capture kinematic handwriting parameters such as velocity, pressure and regularity of hand movements. Afterward, they performed the same tasks during fMRI in a MI and an executed condition.ResultsThe kinematic analysis revealed a general (...) correlation of handwriting parameters during sitting and lying except of pen pressure during drawing. Writing compared to imagined writing was accompanied by an increased activity of the ipsilateral cerebellum and the contralateral sensorimotor cortex. Executed compared to imagined drawing revealed elevated activity of a fronto–parieto-temporal network. By contrasting writing and drawing directly, executed writing induced an enhanced activation of the left somatosensory and premotor area. The comparison of the MI of these tasks revealed a higher involvement of occipital activation during imagined writing.ConclusionThe kinematic results pointed to a high comparability of writing in a vertical and horizontal position. Overall, we observed highly overlapping cortical activity except of a higher involvement of motor control areas during motor execution. The sparse difference between writing and drawing can be explained by highly automatized writing in healthy individuals. (shrink)

Unter dem Dach der Philosophie gingen empirische Forschung und normative Theorie lange Zeit Hand in Hand, bis sie spätestens um die Zeit der Emanzipation der Einzelwissenschaften in eine schwierige, nicht immer eindeutig bestimmbare Beziehung zueinander traten; dieses unterbestimmte Verhältnis tritt uns vor dem Hintergrund aktueller Debatten wieder entgegen. Das zeigt sich zum Beispiel auch bei Fragen der Ethik: In den letzten Jahrzehnten zeigten verschiedene wissenschaftliche Disziplinen verstärktes Interesse an empirischen Bemühungen um ein deskriptives Verständnis von Moral. Hier gibt es nach (...) wie vor eine starke Trennung zwischen den Bereichen der normativen Theorie einerseits und der empirischen Forschung andererseits, wobei in beiden Bereichen dazu tendiert wird, die jeweils anderen Diskurse zu vernachlässigen, wobei Unklarheit über die Möglichkeiten und Grenzen einer fruchtbaren Integration herrscht. Auf der anderen Seite gibt es jüngst auch verschiedene Versuche einer Integration beider Domänen. – Dies macht einen Diskurs über die Bestimmung des Verhältnisses von empirischer Forschung und normativer Theorie nötig, was in diesem Band aus verschiedenen historischen sowie systematischen Perspektiven geleistet wird. We present a vignette study conducted with a quota sample of the German population (n = 400). Subjects had to redistribute a good between two hypothetical persons who contributed equally to the available amount but differed in quantity needed and the reason for their neediness. On a within-subjects level, we tested for the effects of need, accountability, and resource availability on their third-party distribution decisions. Between subjects, we further varied the kinds of needs: The persons either needed the good as (...) a means to survive, to live a decent life, to participate in society, or to be autonomous. Despite equal productivity, the mean share allocated to the needier person was significantly higher than an equal share. However, this share turned out significantly smaller when the needier person was accountable for needing more than the other. Nonetheless, even if accountable, the needier person still got a share larger than their contribution would suggest. When there was a surplus of resources, the needier person got an even higher share than when resources were scarce. (shrink)

To investigate the impact of framing on rule-breaking behavior in social dilemmas, we incorporated a rule in a one-shot resource game with two framing-treatments: One frame was a give-some dilemma (i.e., a variant of a public goods game) and the other frame a take-some dilemma (i.e., a variant of a commons dilemma game). In each frame, all participants were part of one single collective sharing a common good. Each participant was initially equipped with one of five different endowments of points (...) from which they must give/could take amounts to/from the common good. The exact amounts of contributions/withdrawals were regulated by the rule. Participants decided whether to cooperate and comply with the rule or to break the rule to their own advantage and at the expense of the collective (i.e., giving lower/taking higher amounts). Results of an online-experiment with 202 participants showed a significantly higher proportion of individuals breaking the rule in the take-some frame than in the give-some frame. In addition, endowment size influenced the proportion of rule-breaking behavior in the take-some frame. However, the average amounts of points not given/taken too much were not different between the frames. (shrink)

Der Diskurs um den doxastischen Voluntarismus behandelt die Frage, ob es möglich ist, einen Glaubenszustand intentional und mehr oder minder spontan herbeizuführen. Dabei sind historisch verschiedenste Positionen verhandelt worden. Es soll nicht versucht werden, eine Antwort auf die Frage nach der Möglichkeit zu liefern; vielmehr sollen methodische Überlegungen zur Klärung der Frage in den Fokus gerückt werden. Es wird gezeigt, dass die eigentliche Frage präzisierungsbedürftig ist. Exemplarisch wird ein ausgewählter Präzisierungsversuch aus dem zeitgenössischen Diskurs kritisch beleuchtet und ihm wird ein (...) Verständnis der Frage entgegengesetzt, das die Diskussion um die Möglichkeit eines doxastischen Voluntarismus in einen neuen Rahmen einbetten kann. (shrink)

Narrative has proven itself a continuous as well as adaptable means for environmentally oriented expression. Its role goes beyond the mediation of pre-existing knowledge imported into the realm of storytelling from other domains; rather, influential models of the natural world tend to circulate as storyworlds. This special issue of SubStance proceeds from the premise that narratives are not only a sequence of signs encoding a story but also “invisible, elusive representations that exist only in the mind”. For non-additive set functions, the independent product, in general, is not unique and the Fubini theorem is restricted to slice-comonotonic functions. In this paper, we use the representation theorem of Gilboa and Schmeidler (Math Oper Res 20:197–212, 1995) to extend the Möbius product for non-additive set functions to non-finite spaces. We extend the uniqueness result of Ghirardato (J Econ Theory 73:261–291, 1997) for products of two belief functions and weaken the requirements on the marginals necessary to obtain the Fubini property (...) in the product. More importantly, we show that for the Möbius product one side of the Fubini theorem holds for all integrable functions if one of the marginals either is a probability or a convex combination of a chain of unanimity games, i.e., we relax the requirement of slice-comonotonicity and enrich the set of possible applications. The Bavarian and the Indian constitutions were developed in almost the same period of time. Because of historic experiences the prospect of legal certainty was the determining factor for the representatives of the people in India and Bavaria. They elaborated functioning constitutions and integrated their fundamental ideological principles quite naturally. The Indian and the Bavarian constitution are characterized by their aspirations to balance social injustice, particularly by striking a balance between individual liberty and social need.The history of political economy demonstrates (...) a broad variety of interpretations regarding the meaning and function of value concepts. When we review all these value concepts we identify two poles of the value-concept that still lack compatibility with each other in economical and philosophical schools to this day. Value systems have to be applied situation-sensitive and are in need of a frequent critical reflection; they need to be refused or changed if necessary.Examining some examples of the Bavarian Constitution, we indicate some concordances with regard to contents of the Indian Constitutional Law. The equivalences in the Bavarian and the Indian Constitution incorporate entitlements which should protect citizens against an unjustified economical assault upon their existence. The social value conflicts that occur more and more because of the hiatus to the constitutionally warranted values, and that cannot be solved simply by law or political adjustment, are therefore up for discussion. We then examine the disparity between entitlements and reality and discuss the hierarchy of our values. (shrink)
